Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the services operated by H&J Transports LLC ("H&J," "we," "us," or "our"): an online marketplace connecting homeowners and businesses with independent, licensed contractors for home and commercial services — including heating and air conditioning (HVAC), plumbing, electrical, refrigeration, and cleaning (the "Services"). The service categories we offer may change over time.

By accessing or using the Services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Services.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Services. By using the Services, you represent that you meet these requirements and that the information you provide is accurate and complete.

3. What H&J Does and Does Not Do

H&J is an intermediary platform. We connect homeowners and businesses who submit service requests with independent, licensed contractors who may respond to them.

H&J is not a party to the transaction between users. We are not a contractor, and we do not perform HVAC, plumbing, electrical, refrigeration, cleaning, or any other home or commercial service work. We do not employ, supervise, direct, or control the contractors who use the Services. Any agreement, work, payment, or service that results from a connection made through the Services is solely between you and the other party.

No endorsement or guarantee. While contractors on the Services Marketplace represent that they hold the licenses required for the work they perform, we do not independently guarantee the licensing, qualifications, insurance, workmanship, pricing, or conduct of any contractor or counterparty. You are responsible for evaluating and selecting anyone you engage, including verifying their credentials.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and to keep it current. Notify us promptly at jatinder@handjtransportsllc.com if you suspect unauthorized use of your account.

You may sign in using Google OAuth, in which case your use is also subject to Google's applicable terms.

5. User Content and Submissions

You retain ownership of the information and content you submit — service requests, quote requests, documents, ratings, and other materials ("User Content"). You grant H&J a non-exclusive, worldwide, royalty-free license to use, host, store, reproduce, and transmit your User Content as necessary to operate and provide the Services.

You represent that you have the right to submit your User Content and that it does not violate any law or third-party right. You are solely responsible for the accuracy and legality of what you submit, including any business or licensing information.

6. Acceptable Use

You agree not to:

• use the Services for any unlawful, fraudulent, or harmful purpose;
• submit false, misleading, or infringing information;
• attempt to gain unauthorized access to the Services, other accounts, or our systems;
• interfere with or disrupt the Services, including by circumventing rate limits or security measures;
• use the Services to harass, abuse, or harm another person; or
• scrape, harvest, or collect information about other users without authorization.

We may suspend or terminate access for conduct that violates these Terms or that we reasonably believe is harmful to the Services or other users.

7. Communications

By using the Services, you agree that we may contact you using the information you provide, including by email and, where you provide a phone number, by phone or text message, regarding your service request, quote, or account. These are direct, one-to-one communications; we do not currently operate an automated or bulk messaging program. You may ask us to stop a particular type of communication at any time by contacting jatinder@handjtransportsllc.com.

8. Third-Party Services and Links

The Services rely on third-party providers and may connect you with independent third parties. We are not responsible for the acts, omissions, products, or services of any third party, including contractors, counterparties, or the outcome of any transaction you enter into with them.

9. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY CONTRACTOR OR COUNTERPARTY WILL MEET YOUR EXPECTATIONS.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, H&J AND ITS OWNERS, OFFICERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

Because we are an intermediary and not a party to the transactions between users, we are not liable for the quality, safety, legality, or outcome of any service, work, or transaction arranged through the Services.

11. Indemnification

You agree to indemnify and hold harmless H&J and its owners, officers, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Services, your User Content, your violation of these Terms, or your transactions with other users.

12. Termination

You may stop using the Services at any time. We may suspend or terminate your access at any time if you violate these Terms or if we reasonably believe your use poses a risk to the Services or others. Provisions that by their nature should survive termination will survive.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Services will be subject to the exclusive jurisdiction of the state and federal courts located in California.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms. Material changes will be communicated through the Services or by email where appropriate.
